Terms and Conditions

These Terms and Conditions (“Terms”) set out the rights and obligations of Connected Movement (“we”, “us”, “our”) and the party using our services (“you”, “your”).

Deze Voorwaarden zorgen ervoor dat deze omgeving waardevol, gericht en respectvol blijft voor iedereen die erbij betrokken is.

Applicability

These Terms apply to all agreements, registrations and collaborations with Connected Movement.

Any general terms and conditions you apply are expressly excluded, unless otherwise agreed in writing.

Services

Connected Movement offers:

• training and certification
• community-based learning and interaction
• events, both online and in person
• consultancy and advisory services

Where necessary, we may engage third parties in delivering our services. We remain responsible for the quality of delivery.

Training

3.1 Registration

You can register for a training via our website or by separate arrangement.

An agreement is only concluded once we have confirmed your registration in writing.

3.2 Cancellation

Cancellation must be submitted in writing and is subject to the following conditions:

• more than one month before the start date: no charge
• between one month and two weeks before the start date: 50% of the training fee
• within two weeks of the start date: 100% of the training fee

3.3 Changes

We may reschedule, modify or cancel a training due to unforeseen circumstances, including insufficient or excessive registrations or the unavailability of a trainer.

You will be notified as soon as reasonably possible.

Following this notice, you may cancel free of charge within two weeks.

3.4 Participation

We reserve the right to refuse or remove participants who disrupt the learning environment or act in breach of these Terms.

Community

4.1 Nature of the Community

The Community is not a platform for passive consumption.

It is a professional environment where practitioners come together to reflect, challenge thinking and learn from real-world situations.

This only works when participants actively contribute and show respect for the space in which others do the same.

Participation in the Community is subject to the Connected Movement Community Code, which sets out the principles and expectations for participation.

4.2 Access

There are different participation levels, including Explorer, Member, Trainer Member and SPC Member.

Access depends on the applicable membership.

We reserve the right to grant, restrict or withdraw access where necessary to protect the quality and integrity of the Community.

4.3 Conduct

Participants are expected to:

• act professionally and respectfully
• contribute constructively
• participate in good faith

The Community is not intended for promotion, self-marketing or disruptive behaviour.

Where this standard is not met, we may restrict or terminate access.

4.4 Confidentiality within the Community

What is shared within the Community is shared in support of learning.

Participants acknowledge that interactions may involve sensitive professional information.

It is therefore strictly prohibited to:

• share or distribute information obtained via the Community
• use such information for commercial or competitive purposes
• disclose identifiable situations outside the Community

This obligation remains in force after participation has ended.

4.5 General confidentiality

Each party treats the other party’s confidential information as strictly confidential and does not disclose it without prior written consent.

This obligation remains in force during the agreement and for a period of three years following its termination.

Connected Movement retains the right to use general knowledge, experience and insights gained through its services.

4.6 Content

Participants retain ownership of their own contributions.

We may use anonymised and aggregated insights to improve our services, content and learning formats.

4.7 Membership

Membership is intended for professionals who are actively engaged in their own development and in the Community.

Membership types include Explorer, Member, Trainer Member and SPC Member.

Membership commences upon confirmation and, where applicable, upon full payment.

Unless otherwise agreed:

• membership is entered into for a minimum period of 12 months
• membership is automatically renewed for successive periods of 12 months

Cancellation must be submitted in writing with one month’s notice prior to the renewal date.

Early termination is not permitted, except where required by law or deemed appropriate in our judgement.

4.8 Fees

Membership fees are invoiced annually and must be paid in advance.

We may adjust fees upon renewal. You will be informed of this in advance.

Events

Events may be open to all or by invitation only. They may be held online or in person.

Events are designed to bring the Community together and to support ongoing learning and connection.

We reserve the right to modify or cancel events where necessary.

Consultancy

Separate agreements may apply to consultancy services.

In that case, those separate agreements take precedence.

Data protection

Both parties comply with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Where necessary, a separate data processing agreement may be entered into.

Payment

Invoices must be paid within 14 days.

If payment is not received on time, we may suspend access to our services.

We may charge statutory interest and collection costs of 15% with a minimum of EUR 125.

You are not entitled to suspend or offset payments.

Intellectual property

All materials remain our property or that of our licensors.

You may not copy, distribute or reproduce materials, and you may not record sessions without permission.

Liability

Our liability is limited to the amount paid for the relevant service.

We are not liable for indirect or consequential loss, including loss of profit, revenue, business or goodwill.

This limitation does not apply in cases of wilful misconduct or gross negligence.

Privacy

Personal data is processed in accordance with our Privacy Policy.

Governing law

These Terms are governed by Dutch law.

Disputes will be submitted to the competent court in Amsterdam.
